STANDARD WARRANTY
The Manufacturer warrants that the Products shall be free from defects in material, and agrees to replace any such components which prove to be defective in material within one (1) year from the original sale for use, and written notice of which defect shall have been given to the Manufacturer within such period. If Raigatta Energy Inc. (REI) takes care of the mounting procedure or has responsibility of the supervision of the mounting, the warranty is two (2) years. If the system includes the automatic lubrication system the time of warranty is five (5) years.
The warranty does not cover the normally wearing components, such as bearings, nor the defects caused by normal wearing. The warranty does not cover using the Product in extreme or in sudden, unexpected weather conditions. The temperature and wind speed limits are specified in the documentation.
According to the usage prevailing in the trade branch other warranties are not granted, because of the facts that the Manufacturer cannot effect, such as mounting of the turbine and the forces of the nature at the operating site. There are sites and customer groups that are not under this warranty, such as military and boarder guard.
In case of damage under warranty, the damaged component must be sent to the Manufacturer and it will be replaced with a new one on Ex Works condition. Thus, the warranty does not cover any transportation or packing expenses. The Manufacturer’s and REI’s liability shall under no circumstances exceed the invoiced price of any component for which a warranty claim is made, nor shall the Manufacturer or REI or in any event be liable for any consequential damages or lost profits.
Defects caused by device constructions or engineering or foundation work are not included in the warranty. In case the devices have been used against the Manufacturer’s or REI’s instructions or modifications have been done by the Purchaser or a third party, the warranty is not valid. The warranty is also valid only if a Windside controller has been used with the device. If any other grease except Windside Grease has been used with the device, the warranty is not valid.
The Manufacturer and REI do not guarantee that the operations of the Products will be uninterrupted or error-free. The Manufacturer and REI is not responsible for damage arising from the failure to follow instructions relating the use of Products. Either the warranty does not apply to the
a) damage caused by use with non-Windside products,
b) damage caused by accident, abuse, misuse, fire, state of war, exploding, mining activities, forces of nature, such as thundering, electric discharges, earthquakes, flood etc, or any other external causes,
c) damage caused by operating the Product outside the permitted or intended use described by the Manufacturer,
d) damage caused by performed service,
e) product or part that has been modified,
f) prototype or unit that has been built according to the client’s demands, or custom-made products or art works.
EXTENDED LIMITED WARRANTY
The Extended Limited Warranty of 10 years applies only to Windside turbines, all other Windside appliances are under the Standard Warranty.
In addition to the below mentioned terms, the Extended Limited Warranty (ELW) includes also all provisions of the Standard Warranty. This ELW clause is valid only when used together with the Standard Warranty.
Extended Limited Warranty requirements:
1) ELW is granted only in cases where Raigatta Energy Inc. (REI) has given detailed, written information of the customer, mounting place, wind conditions and purpose of use of the specified turbine and photographs of the installation to Oy Windside.
2) In addition to above mentioned the mounting of the turbine must be made by or under the control of REI.
3) The turbine is bought and assembled with the automatic lubrication system.
4) REI must have a Service Agreement (for additional charge) for the warranty period in place and in good standing with the customer regarding the wind turbine.
5) A separate Warranty Certificate is given in ELW cases and it shall include signature and stamp of Windside and it is printed on the official paper of Windside.
6) The ELW does not apply to sea conditions, unless otherwise determined after choosing special components and accessories. Occasionally it can be granted against an extra charge.
